The late medieval Italian communes have been hailed as forerunners of modern Republican government and castigated as ill-conceived and doomed to failure. In her study of the legal records of Bologna, Blanshei (history, Agnes Scott College, emerita) reveals the many factors that caused the failure of the commune, concluding that it was not an inevitable fate. She uses Weber's "closure theory" in which groups define themselves through exclusivity. The records indicate that over the years the groups participating in government declined until the oligarchy was controlled by a few families who jostled for power. Criminal court records show the importance of establishing one's status in order to receive preferential treatment. As the town's economic situation deteriorated, draconian laws were enacted that further limited participatory government. Blanshei gives numerous tables to support her theory along with many examples from the records. These testimonies will interest social historians as well as students of legal and political history.
