A common assumption is that by maintaining competitive markets competition law automatically optimizes consumer welfare. Buttigieg (European and comparative law, U. of Malta) examines how well U.S. antitrust law and European Community (EC) competition law actually protect consumer interests. He argues that unless those interests are specifically addressed during the assessment process, those consumer interests would not be adequately safeguarded. He also contends that consumer welfare should be the only or at least the primary goal of any antitrust regime.
