With the Great Mahele (or "division") of the mid-19th-century, Hawai'i's semi-feudal land system was abolished and the lands of the islands divided, with much of the lands being placed under the personal control of the crown. Van Dyke (law, U. of Hawai'i) conducts a historico-legal analysis of the subsequent fate of the Crown Lands as a means of aiding in ongoing disputes concerning their status. His analysis includes discussion of pre-annexation court cases and legislation, the management of the lands as a public trust by the United States, and the eventual transfer to the state government. He concludes that the Crown Lands should be recognized as a shared resource of the Native Hawaiians, in part because of the difficulty of recognizing any individual claims from the descendants of Hawaiian monarchs.
