Kuppuswamy (U. of Sheffield Law School, UK) conducts an analysis of the Universal Declaration on the Human Genome and Human Rights, adopted by the General Conference of the United Nations Educational, Scientific and Cultural Organization (UNESCO) in 1997, and the Universal Declaration on Bioethics and Human Rights, adopted by the same body in 2005. He argues that an international legal approach to the human genome should be based on a human rights framework underpinned by a unified theory of human rights and that such a framework can be found in the above-cited documents. He further argues that within such a framework, the issue of property rights and patenting of gene sequences can be addressed, particularly in regards to the human right to development.
