Masud (former academic director of the International Institute for the Study of Islam in the Modern World, the Netherlands), Peters (Islam and Islamic law, U. of Amsterdam, the Netherlands), and Powers (Islamic history, Cornell U., US) present 21 papers from an October 2001 international conference on the application of Islamic law in courts. Contributors were asked to construct their essays around one or more court judgments, include a translation of an exemplary legal document, and/or focus on the application of fiqh (legal doctrine) by the qadi (judge) in the daily practice of judging. The selection process sought a balance of discipline, period, region, school of law, language, and legal subject matter. Following a survey of the current state of the subject, 20 papers are organized into thematic sections on the nature and functions of the judgeship and its development over time, the structure of the judicial apparatus, the application of juristic thought to specific cases in selected areas of the law, and judicial procedure and the different forms of evidence.
