In the context of the rights-based discourse of earlier civil rights struggles, Mezey (political science, Loyola U. Chicago) considers the gay community's attempts, through litigation, to achieve social and legal reform in the US over the last 50 years. She examines cases in both state and federal courts to understand the effectiveness of litigation in furthering their goals and assess how the courts have engaged in judicial activism by opposing public opinion or negating policy decisions of other branches of government. Following an introduction on gay rights activism from the 1920s to the 1980s, specific cases address the censorship of erotic materials, the right to privacy, the exclusion of gays from organizations, same-sex marriage, open service in the military, and employment discrimination. Cases were drawn from computerized legal databases, and other primary sources used include legal briefs, congressional committee reports and testimony, presidential papers, and government documents.
