Nielsen (international trade law, U. of Copenhagen, Denmark) conducts a legal analysis of international trade law relating to animals and PPMs (process or production methods) as part of the International Law and Development Series. She focuses on those trade measures designed to protect animals on the basis of environmental or animal welfare concerns, but also addresses broader issues concerning public morals and the environment raised by the World Trade Organization Agreements, the General Agreement on Tariffs and Trade, the Agreement on the Application of Sanitary and Phytosanitary Measures, and the Agreement on Technical Barriers to Trade. The most significant element of her analysis consists of an in-depth analysis of Article XX of the General Agreement on Tariffs and Trade. She argues that traditional textual interpretation of sub-sections (a), (b), and (g) leads to overlap that is not in conformity with the principle of effectiveness in treaty interpretation and therefore proposes a systematic analytic framework that divides measures under those sub-sections into distinct categories of internal measures, non-product-related PPMs, and product-related PPMs, arguing that such a framework can resolve that overlap in GATT XX analysis.
