Nimmer (U. of California at Los Angeles School of Law and Irell & Manella LLP) anthologizes 13 of his previously published essays examining various aspects of the US Copyright Act of 1976 and its many amendments. He surveys the law as a whole before turning to specific aspects, including durational terms and prospects for recapture, strictures for determining repeat offenders under the Digital Millennium Copyright Act (DMCA), reconciliation of anti-circumvention strictures of the DMCA that are almost identically worded but have different foci, the effectiveness of the fair use provision of the Copyright Act of 1976, the preemptive effect of the Copyright Act on state law, the effect of the Copyright Act on federal trademark law, and the non-statutory issues of substantial similarity and of access.
